MaRisk
The German minimum requirements for risk management demand that institutions document their processes and the qualification of those involved. For personnel selection that means not only who was hired, but on what basis. flynne holds the type of procedure, the participants and the results together, ready for inspection and without searching through files.
Expertise in investment advice
For investment advisers, sales officers and compliance officers, expertise and reliability have to be evidenced and reported to the supervisor. flynne carries the evidence as a stage of the procedure with a status and an expiry date, and warns before anything lapses.
Anti-money laundering law
Employees in certain functions have to be reliable, and the institution has to check that. flynne does not issue the check, but it records whether it exists and only allows dependent steps once it is done.
KWG, professional suitability and reliability
For managing directors and key function holders the supervisor examines both. The assessment has to rest on traceable grounds. That is exactly what a structured procedure documents, and exactly what is missing from a conversation without a record.
DORA
The European regulation on digital operational resilience also looks at personnel capacity. An institution that cannot fill its IT security roles has a supervisory issue, not only an HR issue.
DIN 33430 and the EU AI Act
The standard for occupational aptitude assessment requires documented procedures and qualified participants. The supervisor does not ask about the standard, but does ask for exactly the traceability it describes. The EU AI Act draws a clear line on top: systems that take part in hiring decisions count as high risk. That is why flynne judges nobody.
Every role brings its own rules, its own participants and a bottleneck of its own.
Investment advice and sales
Expertise has to be evidenced before the first client conversation, and the supervisor expects the institution to be able to prove it. Selection and evidence therefore do not run one after the other but interlocked: anyone who passes the selection but does not produce the evidence cannot start.
Credit decisions and back office
What counts here is judgement under incomplete information, not sales talent. The procedures need case work rather than self-assessment, and assessors from the field who have taken such decisions themselves.
Management and key function holders
For managing directors and key function holders the supervisor examines professional suitability and reliability. The selection procedure has to be able to show what the suitability statement rests on: years later, to people who were not there.
Compliance, anti-money laundering and audit
These functions have to be independent, and that is exactly what the supervisor checks on the personnel side too. Selection here means establishing suitability and at the same time evidencing that there are no conflicts of interest.
IT and information security
Since the supervisor started examining digital operational resilience, filling these roles is itself under review. The market is empty, so the procedures have to be fast, and documented nonetheless.
Yes, as a stage of its own with a status and an expiry date. flynne does not issue the evidence, but it records which evidence exists and which steps depend on it, and it warns before expiry instead of leaving it to one person’s calendar.
Per procedure: which requirements applied, who took part, with which qualification, when it was checked and how it was decided. Reportable per site and role. Plus the documents on our own operations: security certificates, technical and organisational measures, deletion concept.
Yes. Types of procedure, requirements and documents are configured per country while reporting stays global. The data remains within the EU throughout.
No, and that is a decision of principle. flynne organises the procedure: appointments, rooms, examiners, documents, deadlines. The suitability statement is made by a qualified person. That keeps the decision where the supervisor expects it.
